You could argue that ALL laws that say "you can't do X" are pushy. Demonstrably, smokers as a group were not able to be sufficiently caring for their fellow man (esp children and asthmatics but to a lesser extent everyone else) too, despite knowing the harm they were causing (is that not persuasion enough? if I'm actually harming someone else and have it pointed out, I jolly well stop!), so action had to be taken.
