They may have trademarked the name 'Tolkien' in the States, but I'm pretty sure that's not possible in the UK. They would have to trademark it in every font and colour and size... and it would still only apply to books.
I must admit I am not that keen of the idea of the book myself, but the badges?! Also, his name is not part of his creations ;-)
Also, I have no illusions of the purity of his thought, and although I'd like to have met him, I am not sure I would have liked him. But at least he was possessive of his own work - I'd be more understanding of the TE's actions if they didn't make money out of his work...
